HANCOCK COUNTY — An intoxicated Yorktown teenager who officials say drove recklessly through the county at speeds reaching over 125 mph before crashing has been arrested and charged with multiple crimes.
Byron Matthew Pomeroy, 18, 8000 block of West Grandview Drive, Yorktown, was arrested Tuesday, Aug. 30 after a lengthy investigation from an incident in late May. He is facing a Level 5 felony count of causing serious bodily injury when operating a vehicle while intoxicated, a Level 6 felony charge of criminal recklessness and five different misdemeanors.
The case against him was officially opened last week. Pomeroy made his initial appearance in Wednesday, Aug. 31 in Hancock County Superior Court 1 via video where Magistrate Cody Coombs set a $5,000 cash bond.
According to a probable cause affidavit, an official from the Hancock County Sheriff’s Department was dispatched to a vehicle accident with injury in the 8000 block of N. Ind. 9, Greenfield Saturday, May 28.
The deputy observed a silver passenger car partially submerged in a stream on the property with significant damage to the vehicle where all airbags had been deployed, the report stated. Officials noted both occupants in the vehicle laying on the grass nearby. The driver was identified as Pomeroy, the report stated.
Officials noted Pomeroy had sustained a concussion while the female passenger, who had a swollen jaw, was going in and out of consciousness. The report later stated she sustained a fractured ankle, severe bruising to her left cheek and numerous minor injuries all over her body.
A witness told officials that they were sitting at the intersection of Ind. 9 and Ind. 234 when they saw a vehicle traveling at an extremely high rate of speed that did not stop at the four-way stop. The witness then saw sparks and believed the vehicle had struck a utility pole, the report stated.
The witness told officials that Pomeroy did not seem concerned with the passenger’s well-being and advised he made the comment he was going to be arrested for DUI and he was concerned about getting fired from his job, the report stated. Both Pomeroy and the female passenger were transported to Methodist Hospital.
Officials noted in the report the vehicle was traveling so fast that when it hit the pole it became airborne and then went into a stream and then an embankment. Officials were able to use a tracking device the female passenger had while in the car called “Life360”and were able to find the car she was in that night traveled 100 mph or more and did not stop or brake at the intersection.
Further evidence collected by Sheriff’s officials from the vehicle show speeds in excess of 125 mph just prior to the crash.
People in a vehicle traveling with the car driven by Pomeroy told officials they were coming from a party at Adagio’s, 5999 West Memory Lane and were headed back to Yorktown when the accident happened, the report stated. Officials did a blood draw on Pomeroy. The results of the chemical test returned showing a blood alcohol concentration of .147 while .08 percent blood alcohol level is the legal alcohol limit in the U.S.
