HANCOCK COUNTY — An Indianapolis man who officials say was hanging out in a community park smoking marijuana is now facing a felony gun charge after officials found a loaded weapon in his vehicle.

Marian Christopher Scott, 22, has been charged with a Level 4 felony count of unlawful possession of a firearm by a serious violent felon and a Class B misdemeanor count of possession of marijuana stemming from an incident Aug. 17.

Scott’s case was opened with an initial appearance in Hancock County Circuit Court earlier this week when the court set a $10,000 cash bond. Jail records show Scott is due back in court Oct. 24.

According to a probable cause affidavit, Scott’s records show he was formerly convicted of armed robbery in Hendricks County and should not have had a weapon in his possession but did when police searched the vehicle.

Officials from the Cumberland Police Department were in the Autumn Wood’s Community parking lot around 5:50 a.m. Aug. 17. That’s when the officer noticed a vehicle not parked properly and in a parking area for residents only with no lights on, the report stated.

According to the affidavit, when an officer activated emergency lights indicating a stop, the driver, later identified as Scott, opened his door. The officer observed a cloud of smoke exit the vehicle.

Officers, the report stated, said Scott told officials he and a woman in the vehicle were just smoking marijuana and lived in the area but didn’t identify an address. When officials asked them to get out of the vehicle, police searched the car. That’s when officials found a loaded firearm under the driver’s seat.

The affidavit noted Scott was previously convicted of armed robbery in October, 2020 in Hendricks County, so he was placed under arrested for unlawful possession of a firearm by a serious violent felon. He was also charged with possession of marijuana after officials found the drug in his vehicle.

The woman Scott was with was released at the scene, the affidavit said.
