HANCOCK COUNTY — An Indianapolis man accused of illegally possessing a firearm was sentenced late last week in Hancock County Circuit Court following the acceptance of a plea deal by Judge Scott Sirk.
Marcus Legg, 37, was charged with a Level 4 felony count of unlawful possession of a firearm by a serious violent felon from an incident in June of 2023. He was also charged with a Class A misdemeanor count of driving while suspended, which was dismissed as part of the plea deal.
According to court records, Legg was given a six-year term at the Indiana Department of Corrections with three years suspended to probation.
According to a probable cause affidavit, an official from the McCordsville Police Department was waiting for a train to cross the tracks in the 2600 block of West Garden Street when the officer observed a vehicle go around the safety arms of the crossing stop-arm.
The officer conducted a traffic stop on the vehicle and the driver, Legg, told the officer he was in a hurry trying to get to Anderson for a family emergency, the report stated. Legg told the officer he didn’t have a driver’s license, but provided an ID and stated that he did have a gun, which the officer collected and noted the gun was unloaded and did not have a magazine. A loaded magazine was found later inside the vehicle, the report stated.
A standard records check on Legg revealed he was driving while suspended, was a convicted felon in Marion County and was not to be in possession of the gun, the report stated.
