HANCOCK COUNTY — A New Castle woman who was facing seven different drug crimes, including a Level 4 felony count of possession of methamphetamine, had her case settled this week in Hancock County Superior Court 1.
Brittney Nicole Whitaker, 39, 1ooo block of South 17th Street, was arrested in January and charged with the Level 4 felony and six different drug misdemeanor charges. Her plea deal called for her to admit guilt to the Level 4 crime.
The agreement, which was accepted by Judge D.J. Davis on Wednesday, called for a four-year term with two years to be executed in the Hancock County Community Corrections Home Detention program. That includes for Whitaker to begin treatment at the Hickory Treatment Center and to remain at the facility for as long as the medical staff deem is needed. The remaining two years will be served on probation.
The state agreed to dismiss the six remaining misdemeanor drug charges if Whitaker follows the agreement and gets help.
According to a probable cause affidavit, Whitaker was arrested in Greenfield in early January by officials from the Hancock County Sheriff’s Department after she was pulled over for having an expired license plate.
Officials pulled her over at CR South 600W and U.S. 40 for a traffic stop Jan. 6 and noticed the smell of marijuana coming from the vehicle, the report stated. Officials did a search of the vehicle and found marijuana, illegal pills, a burnt pipe and a plastic bag with a crystal like substance that did positively field test for methamphetamine, officials said in the report.
Court records state Whitaker was remanded to the Hancock County Jail awaiting result of a Henry County case. She is then to be remanded to the treatment center.
