Rape charges dropped against Greenfield man in plea agreement

HANCOCK COUNTY — A Greenfield man who was facing a charge of rape after a woman he’d met online reported he had sexually assaulted her, had the charge dismissed as part of a plea agreement.

Kurtis Wayne Johnson, 32, was charged with a Level 3 felony count of rape and a Level 6 felony count of sexual battery from an incident in January 2021. Late last week in Hancock County Circuit Court, judge Scott Sirk accepted a plea agreement which dropped the rape charge.

On Thursday, July 14, Johnson admitted guilt to the Level 6 felony sexual battery charge and was given a 760-day term during a plea agreement and sentencing hearing. Johnson had 380 days credit as well as 380 days earned for good behavior and is no longer listed as an inmate in the county jail.

Prosecutor Brent Eaton noted there were several circumstances at play in the case and behind the plea agreement, and said the victim in the incident had agreed to the deal and was ready to move on.

A probable cause affidavit filed in the case stated a female victim from Anderson reported to the Greenfield Police Department in January 2021 she’d met Johnson through Facebook Dating and they’d been communicating via Facebook Messenger before meeting.

The woman said she went to visit Johnson at his house, which she believed was in the 1100 block of Walnut Street in Greenfield, according to the affidavit. She told officials she was awake for a couple hours before falling asleep in Johnson’s bed. She woke up as he was performing a sex act on her. The woman told him to stop, the affidavit continued, adding he stopped and moved away from her. She reported she never gave him verbal or implied consent for any type of sexual contact.

The woman said she waited until Johnson’s roommate returned home and told her what had happened. The roommate’s boyfriend then took the victim back to Anderson, the report said. Once home, the victim told her father what had happened, and he told her to contact the Anderson Police Department, the affidavit stated.

Johnson was originally booked into the Hancock County Jail in October of 2021 where he pleaded not guilty at his initial hearing.
